Terms of Use

1. Acceptance of these terms

By accessing or using the Site, or by opting in to receive text messages from us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or our SMS program. If you use the Site on behalf of an organization, you represent that you are authorized to accept these Terms for it.

2. Using the Site

You may use the Site for lawful purposes, to learn about AlphaBitCore and its products, and to contact us. You agree not to:

• Use the Site in violation of any applicable law or regulation;
• Attempt to gain unauthorized access to the Site, its servers, or any connected system, or probe, scan, or test its vulnerabilities without our written permission;
• Interfere with or disrupt the Site, including by transmitting malware or placing an unreasonable load on its infrastructure;
• Scrape, harvest, or collect content or data from the Site by automated means, except as permitted by our robots.txt file; or
• Submit false information, impersonate any person, or submit another person’s contact details or mobile number without their permission.

3. Intellectual property

The Site and its content — including text, graphics, logos, research reports, diagrams, and software — are owned by AlphaBitCore or its licensors and are protected by intellectual property laws. You may view, download, and print Site content for your own informational, non-commercial use, provided you keep all copyright and other notices intact. You may quote reasonable excerpts of our published research with attribution. Any other use requires our prior written permission.

AlphaBitCore, Nexus, and our logos are trademarks of AlphaBitCore. You may not use them without our permission, except to refer accurately to our products.

4. Products & separate agreements

Information on the Site about our products is provided for general information. Your use of AlphaBitCore software and services is governed by the agreement that applies to it, not by these Terms:

• Nexus AI Gateway source code is governed by the license published in its GitHub repository.
• AWS Marketplace subscriptions are governed by the terms presented on our AWS Marketplace listing and by AWS’s own terms.
• Enterprise deployments are governed by the order form and master agreement you sign with us.

If these Terms conflict with one of those agreements, that agreement controls for the product it covers.

5. SMS text-messaging program

AlphaBitCore offers an SMS program for people who provide a mobile phone number and expressly opt in to receive text messages from us. By opting in, you agree to the following:

Program description

We send messages related to your relationship with us, such as replies to your inquiry, scheduling and reminders for briefings or walkthroughs you request, and account or service notifications. Opting in is not a condition of any purchase.

Message frequency and cost

• Message frequency varies based on your interactions with us.
• Message and data rates may apply. Check with your mobile carrier for details about your plan.

How to opt out and get help

• You can cancel at any time. Reply STOP to any message. We will send one message confirming that you have been unsubscribed, and you will receive no further messages unless you opt in again.
• Reply HELP to any message for assistance, or email hello@alphabitcore.com.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and device and is not guaranteed.

Your number

You confirm that you are the account holder or an authorized user of the mobile number you provide. If you change or give up that number, reply STOP from it first or tell us so we can remove it.

Privacy

Our Privacy Policy explains how we handle your mobile information. We do not share mobile information or SMS opt-in data with third parties or affiliates for marketing or promotional purposes.

6. Your submissions

When you send us information through the contact form, by email, or by text message, you confirm that it is accurate and that you have the right to share it. Please do not send confidential, sensitive, or regulated information through these channels. If you send us ideas or feedback about our products, we may use them without obligation to you.

7. Third-party sites & services

The Site links to third-party sites and services, such as GitHub and AWS Marketplace, that we do not control. Your use of them is governed by their own terms and policies, and we are not responsible for their content or practices.

8. Disclaimers

The Site and the SMS program are provided “as is” and “as available.” To the fullest extent permitted by law, AlphaBitCore disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Content on the Site, including research, benchmarks, and regulatory mappings, is for general information only. It is not legal, compliance, financial, or investment advice, and you should not rely on it as a substitute for advice from a qualified professional.

9. Limitation of liability

To the fullest extent permitted by law, AlphaBitCore and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or the SMS program. Our total liability for any claim relating to the Site or the SMS program will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold AlphaBitCore harmless from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which AlphaBitCore is organized, without regard to its conflict-of-laws rules, except where the law of your place of residence requires otherwise. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes to the SMS program will also be sent to active subscribers by text message. Your continued use of the Site or the SMS program after an update means you accept the revised Terms.
